Certified Records
Certified records are a type of document that encompasses a wide range of contents. The key characteristic of certified records is that the notary attests to specific facts, such as statements made by individuals, the condition and status of a particular property, the contents of websites, deposits of money or other assets in the Notary Public’s custody, and more. These certified records serve as valid evidence for all parties seeking the intervention of a notary.
Key types of certified records include:
Records of Manifestation
Records of Presence
Records of Deposit
Records of Mail
Records of Acknowledgment
Records of Manifestation
In records of manifestation, notaries certify that one or more individuals have made specific statements in their presence concerning particular facts.
Records of Presence
Records of presence allow the notary to certify, often with photographic evidence, specific circumstances or conditions related to a location or asset, usually a property.
Records of Deposit
A record of deposit involves the notary receiving a specified and secured amount of funds, which will be made available to one or more individuals once certain pre-determined conditions are met. Non-monetary items can also be deposited.
Records of Mail
In records of mail, the notary certifies the dispatch of a letter (and, if applicable, the response received) by certified mail with a request for a receipt.
Records of Acknowledgment
Through records of acknowledgment, the notary certifies that one or more facts have been acknowledged. This certification may serve various purposes, such as confirming that two people are in a civil partnership, that they are separated after having been spouses or cohabitants, or that someone has been the de facto guardian of an individual requiring support due to incapacity.
